Does anyone know anything about them??

The reason I ask is because my work had be working 9 days in a row with 9hour shifts every day. Wouldnt that be considered overtime?

I confronted them about it on day two after I had told Toby about it, and they said that they could schedule us up to 9 days but after that their computer freaks out. :puzz I dont care what their computer does, I just want to know if this is ethical. I mean I can work those hours, thats fine, I just want to get my overtime pay if it applies kwim?

Tehcnically if you work more than 40 hrs in one week(7 days, I believe) it is overtime and automatically should be caluclated that way. You are scheduled for 9 hr shifts to account for 1 hr clocked out lunch or so.

Yeah I have 9 hour shifts with 45 min lunch. And it was from Monday to Wednesday. Would that count?

Technically then you are working 8hrs and 15 mins a day...So you should get the 15mins of those days as overtime thats within one working week.

When does the pay period end... that can make all the difference in the world. We have a pay period that runs Friday through Thursday and I get screwed hours wise ALL the time. They had me working 17 days straigth and because of the way the pay period worked I WASN'T getting the overtime I SHOULD have gotten.

that is how most companies get around it.... it's all in how the pay period is set up.

I'm not sure on the pay periods...I will have to check. That sucks Steph! 17 days!? Ugh I would DIE!

Oh, and I have another question..can they deny your availablility? I ask because when they hired me, I told them I could not work Sundays, they told me I had to put down that I was available for the mornings atleast and they would never actually schedule me for a sunday. Well, I have worked EVERY Sunday but the ones I took off. So, now, Sundays really do not work out for us cuz Toby is working on them and I dont have anyone to watch Elizabeth now because my gma is out of town on the weekends taking care of my cousins and their step brothers. So 4 kids in a PT Cruiser with a carseat...yeah right! So anyway, I changed my availability (they have forms for that) and they DENIED IT! Can they legally do that? I mean they claim to be flexable and I explained to them that my family comes first and if for whatever reason I need to be home with my daughter, then I will be regardless of the schedule. They agreed to that and signed my paper and everything (I have it in writting) but now they are saying that if they schedule me a Sunday, then I either have to find someone to take my shift (which wont happen) or they will fire me for not showing up! WTF?! So now I dont knwo what to do. I am half tempted to show up to work with my daughter!

yea they can. if it's a day that you cant work, you never should have put it down in the first place.

If your working 9 hours days and taking a 1 hour lunch that's 8 hours in total per day, standard work week of mon-fri would be 40 hours. If your working 9 hours, *unincluding* the lunch. So really 10 hr days, 9 hrs billable daily, 5 days a week - that's 45 hrs a week. That's 5 hours Overtime. If your an "hourly" employee your entitled to OT. If your "salary" no. I've never worked in CA so I'm not sure on that aspect. But for general employee/payrolling I would say your entitled to OT girl.
