Ok we do all of our closing paperwork tomorrow. But come to find out the owners of the house wont even be completely out tomorrow.
Are they legally supposed to be out of the house completely tomorrow?
Because they wont be. They are not moving their stuff till tomorrow.
If they are supposed to be out by tomorrow should we charge them for being there or ask money off of our closing costs?
My MIL said I should do that. :dunno
Kinda frustrated that they wont be out of the house tomorrow like the relator said they would be.

amazinggrace 06-30-2008, 10:06 PM Yes they should be out and the house should be basically clean (vaccumed floors etc..), you should get the keys at closing. From the moment you sign those papers the house is your, your paying the mortgage and your homeowners insurance is in effect (So if anything gets messed up in their move out it would go on your home owners insurance) Since it's just a day...it's up to you...I wouldn't be happy though. :goodluck

Im not sure how long its going to take for them to be out. I know they have movers coming at noon to move the big bulk stuff and they have a Uhaul and moving the rest themselves.
We are supposed to be moving in stuff that day.
just annoying that we still have to work around them.
goldilockz 06-30-2008, 10:10 PM Yeah it doesn't sound right that they are still there. We are doing our final walk through 2 hours before we close, to make sure all is well and clean and to our standards.

froglove 06-30-2008, 10:15 PM We did the walk thru yesterday. They do it 48 hours before closing out here. Weird I know.
They house is very clean, shes always kept it clean. Just frustrated that they will still be moving stuff out while we are moving in.
I just found out that its probably because they are not signing the closing papers until after we sign ours( they are buying a house elsewhere). :dunno just so stupid
They should of signed on their house they bought sooner and out by the 1st.
JulieM 06-30-2008, 10:22 PM The last house we bought, the sellers needed a few days after closing to get their stuff out, so it was written into the contract that they would be renting back for XX number of days after closing. They paid us rent for those days.

Callie 06-30-2008, 10:28 PM As far as I know they should be out of the house by the time you close on the house. When we bought our house it was brand new so as soon as we closed we went in, and when we sold it at closing we handed the lady the keys and we were done.
deewix 06-30-2008, 10:28 PM I would be charging them rent. When you sign the paperwork and get the keys, that house is yours and they should have moved all of their stuff beforehand, unless they had made arrangements to stay.

amazinggrace 06-30-2008, 10:34 PM I would call you agent tonight to give them a heads up that way they can alert the lawyers/title company to make the changes. The house isn't actually yours until you and the sellers sign the papers. So that may be how they are getting around it. They may not plan to sign until they are done moving out, then technically you shouldn't move in till they sign either. Sorry, that is a little messy. It will all be yours soon though :)

froglove 06-30-2008, 10:39 PM Well we sign the papers at 9 and the owners sign at 10:30. But they arent having movers there till noon. Kinda strange.
Oh well.... maybe we can convince them to leave a few more things there( like her frog garden stuff :lol)

Shaky 06-30-2008, 11:02 PM They must be out of the house at the moment you get your keys. You get your keys and that house is completely yours unless there was an arrangement set up already.
You can charge them rent for the day and that's what you should do.
I would insist they either pay you rent or have them have a uhaul at the signing with their belongings. Once you sign those papers the house is yours.
Lckychrmzz 07-01-2008, 05:58 AM They should be out by the time yall sign the papers unless stated in the contract that they need extra time. Then you can charge them rent/fees whatever. You should be getting the keys at closing. I think its very rude that they wont be out by the time of closing.
When we bought this house we did the walk through 2hours before closing and it was completely empty. Well, besides their hideous curtains and a snow blower lol They signed the papers first and then we did.
Caimbrie 07-01-2008, 09:00 AM A lot of times there will be an agreement that the sellers will stay for x amount of time and will be charged x amount per day/week they are their after the closing. If there was no agreement made like that then they are supposed to be out before you even close on the house.

I would write up a contract with them on the day you sign the paper giving them a date to "move out by" and the amount of money you will be charging them to stay there till that date. It is your legal right.

The only problem is that kind of stuff is supposed to be handled well before the closing. She closes today.

This is exactly what should be done. In our situation we had a VA loan on our old house that was being sold. In order to get a new VA loan, you have to close out the current one. That might be why they are closing on this one before signing on their new house.
Heather 07-01-2008, 12:30 PM Thats strange they wouldn't have gotten their stuff moved before hand. The keys they have to get in the house are the keys you're supposed to get when you sign the closing papers. I'd be frustrated but if it is only one day and they will be done I'd personally just be annoyed but I'd let it go.

Hopefully there is something your agent can work out.
Jordan 07-01-2008, 02:09 PM They have to be out of the house prior to closing. If they aren't, it has to be something worked out in advance by the two of you. We had to do that once, and we paid rent to the buyers for the week that we were there.

If it's only one day, I wouldn't either. If it's a couple days to a week, than I would. Especially if she is misplaced (staying in a hotel...etc) during that time.
