Accused dad refuses foster care for burned baby
A court hearing today will settle dispute with CPS

GALVESTON — A court hearing was set for today after the man accused of burning his 2-month-old daughter in a microwave oven refused Wednesday to relinquish the girl to foster care.
The child's mother, who had vowed to fight for custody, relented and agreed to allow her daughter to remain with foster parents.
The child was placed with them on Monday after being released from Shriners Burns Hospital in Galveston.
Joshua Joyce Mauldin, 19, of Warren, Ark., failed to reach an agreement with Child Protective Services during a three-hour closed meeting in Galveston Family Court before a mediator, CPS spokeswoman Gwen Carter said.
Mauldin's refusal to agree with CPS to allow his daughter to remain in foster care means the dispute will be decided at a 3 p.m. hearing today before Associate Family Judge Suzanne Radcliffe, Carter said.
Carter said the CPS agreement with Eva Marie Mauldin, 20, was confidential.
She said the mediation is the beginning of an investigation to determine who will take permanent custody of the child.
Joshua Mauldin remains in the Galveston County Jail on $250,000 bail after his indictment last week on one count of felony injury to a child.
He is accused of throwing his daughter on a bed, hitting her in the groin and placing her in a hotel room safe, refrigerator and microwave oven May 10.
He faces a sentence ranging from five to 99 years in prison and a $10,000 fine
